Permitting Process

KRCD is committed to a comprehensive public outreach effort related to the site selection and permitting process for the proposed power plant.

The California Energy Commission (CEC) has the sole responsibility for permitting power plants of 50 megawatts or more, but seeks input from local and state agencies as well as the public at large.

To start the permitting process, KRCD submitted the a Application For Certification in September 2007. This public document includes over a year's worth of studies regarding the proposed power plant.

The permitting process usually takes about a year to complete from the time the submitted application is evaluated and deemed to be "data adequate". The CEC evaluates all environmental, operational and other issues related to permitting the plant and requires that the plant meet all local laws, ordinances, regulations and standards as well. To make this process successful, public participation is strongly encouraged.

Numerous public meetings are held by the CEC to provide for public comment. Throughout the CEC process, meetings, conversations and documents are all publicly shared. Private communication between KRCD and the CEC is prohibited.

In order to receive final approval to construct the plant, KRCD will have to obtain the approvals of three separate agencies: the CEC, the San Joaquin Valley Air Pollution Control District and Region IX of the U.S. Environmental Protection Agency.
